Terms of Service

Purpose, definitions and acceptance

These Terms of Service (“ToS”) govern access to the MeshTalker website, application, store and services published by Blocnet. “User” means any person using the Service; “Room” means a group discussion space; “Owner” or “Administrator” means the user with the administration functions actually offered.

By using the Service, the user acknowledges having read and accepted the applicable ToS. If acting for an organization, the user declares that they have the necessary authority. Persons who cannot legally enter into a contract must obtain the required authorization.

Access and features

MeshTalker notably enables private conversations, rooms, member management, end-to-end encryption mechanisms and certificate-based identity. Available features depend on the version, platform, rights and purchased product.

The user must have a compatible device and Internet access. They are responsible for keeping their environment up to date and for not altering the security mechanisms.

Private conversations and rooms

The user chooses their contacts and remains responsible for the content transmitted. For a room, the creator or owner may, depending on the features actually available, invite or manage members, permissions, revocations or exclusions. Powers not offered by the application are not granted by the ToS.

The owner must use their functions judiciously and ensure that their use of the room and invitations complies with the law, third-party rights and the ToS. Each member remains responsible for their own conduct.

Encryption, confidentiality and local-first operation

The Service is designed to protect communications through encryption and avoid a central archive database of conversations. Messages and files are mainly stored, in protected form, on devices; they may transit or be temporarily relayed for delivery.

This architecture may prevent Blocnet from having plaintext access to content and limits its technical ability to retrieve, moderate or restore a conversation. It does not make the Service invulnerable and does not release either Blocnet or the user from their legal obligations.

Certificates and cryptographic identity

Certificates, keys, signatures, fingerprints and associated metadata are used to authenticate devices or members and manage rights. The user must not share, forge, divert or fraudulently use an identity or certificate.

Necessary metadata or cryptographic events may be replicated or recorded in immutable technical logs. They should not be confused with a plaintext copy of conversations.

Device security, local secret and loss of access

The user is responsible for the security of their device, their local secret or password, their keys, their access credentials and, where they exist, their backup or recovery means. They must lock their device and prevent any unauthorized use.

Given local encryption, Blocnet may be technically unable to reset a local secret or recover lost encrypted data. Loss of the device, the secret or a backup may therefore result in permanent loss of access. Backup and restore features should be considered available only when they are actually offered in the application.

Purchases and Stripe

Some rooms or services may require a purchase. The store code provides for Stripe Checkout and activation after technical confirmation of payment, followed by delivery of the certificate according to the applicable workflow. Stripe processes card data in its own environment; Blocnet processes the transactional information necessary for provision.

These ToS do not replace Terms of Sale. establish separate Terms of Sale before marketing to consumers, with pricing, payment, performance, withdrawal rights, refunds, warranties and mediation adapted to the business model actually chosen.

Prohibited uses

It is prohibited to use the Service for illegal activity, unlawful threats or harassment, fraud, impersonation, infringement of third-party rights, or the dissemination of content without sufficient rights.

Malware, attacks or attempted compromise, unauthorized access, disruption of the Service, circumvention of protections, abusive analysis, and the fraudulent use of identities, keys or certificates are also prohibited, as is any use prohibited by applicable law.

Content and user responsibility

The user warrants that they have the necessary rights and authorizations over the content they transmit and must respect privacy, intellectual property and other rights of individuals. They assume the consequences of their choice of recipients and their administrative acts.

Where content appears unlawful, the user may write to contact@blocnet.fr with sufficiently precise information. Because of encryption, Blocnet may not technically have the plaintext content; this does not prevent examination of the measures legally and technically available.

Restriction or suspension

Where technically possible and proportionate, Blocnet may restrict or suspend access, delivery or a function in the event of a security risk, fraud, non-payment, serious or repeated breach of the ToS, or legal obligation. The user will be informed when the law permits and when this does not compromise security.

Availability, maintenance and evolution

Blocnet does not guarantee uninterrupted access. Maintenance, updates, networks, service providers, incidents or force majeure may affect the Service. Blocnet may change or remove features for technical, legal, economic or security reasons, while preserving mandatory rights and reasonably informing users where necessary.

Intellectual property

Blocnet and its licensors retain their rights in the Service, its software, trademarks, interfaces and content. The ToS grant only a personal, limited, non-exclusive and revocable right to use the Service for its intended purpose. No rights in the user’s content are transferred beyond the technical processing necessary for provision.

Blocnet’s liability

Blocnet is liable for its obligations within the limits of applicable law. It does not promise absolute security, permanent availability or recovery of data that the architecture keeps exclusively on the device. It is not responsible for the user’s choice of recipients, content or unlawful acts, except where the law provides otherwise.

No clause limits liability for bodily injury, gross negligence or wilful misconduct, nor mandatory consumer warranties and remedies. For professionals only, indirect damages and business losses may be excluded to the extent permitted by law.

Personal data

Data processing is described in the Privacy Policy, which distinguishes local data, Blocnet’s processing and that of service providers. The user must lawfully inform the persons whose data they introduce into a room when that obligation falls on them.

Force majeure

No party is liable for a failure caused by an event reasonably beyond its control and meeting the legal criteria of force majeure, for the duration and to the extent of its effects.

Modification of the ToS

Blocnet may modify the ToS to reflect changes in the Service or the law. The date is updated and appropriate notice is provided for material changes. Continued use after entry into force constitutes acceptance where the law permits; otherwise, express agreement will be requested.

Governing law and disputes

The ToS are governed by French law, without depriving consumers of the mandatory protections of their country of residence. The parties will first seek an amicable solution by writing to contact@blocnet.fr.

The consumer may use the competent consumer mediator free of charge once that mediator has been designated. provide the consumer mediator details before any offer to consumers. They may also bring proceedings before the competent courts according to mandatory rules. Between professionals, subject to mandatory rules, the competent courts within the jurisdiction of Blocnet’s registered office shall have jurisdiction.
